SARS Remission for Admin Penalties . how to go about it ?

    Good Day Ladies and gents

I have a few clients and clients approaching me regarding Admin penalties issues by SARS

    1 thing I need to know :

What reason can I use for requesting Remission ?

The clients didn't file especially when they not in business and returns are ZERO returns . They say they didn't know they must submit.

What reason will SARS accept in Waiving the penalties?

My other client is a foreign national and was out of SA for 4 to 5 years . now he is Owing Admin Penalties. What reason can i Use in this case?

    Kind Regards
    Rourke Buys

    Hi Rourke

You can try disputing it. Normally if you can show that SARS have not been prejudiced, they will credit it.

    Thanks for the reply Andromeda

The part I'm struggling with is the reason for Disputing .

If you can assist here ?

The client is dormant and no activity at all. Can this be a valid reason that sars will accept ?

I don't want to submit a dispute and mess it up . If someone has done this successfully then it can be used as a sort of president going forward.

    Kind Regards
    Rourke

The penalty is because they feel that somehow they have been prejudiced, which is not really the case. That you should point out. Attach the assessments for the delinquent years. They will most likely still charge a penalty, but it should be reduced.
