    I've never before seen 2 way switching wired like this.
    It will work, however the outer screw section of the ES lamp changes from live to neutral depending on the position of the switches which makes it illegal.

    Now lets say it was a BC lampholder.

    Would it still be illegal and why ?

    There's a couple of issues with it although it may not be íllegal'as such and the good thing with it is you won't get lamp flicker when it's off because both sides of the lamp will be at the same voltage. At a glance the biggest problem for me is that you're possibly gonna kill lazy electricians that don't test for isolation because in one of the óff'configerations both sides of the lamp will be at live voltage.
