    Use of Surname

    Good Day thanks for accepting me , seems like a great forum community.

    My husband and I have been married for 20 years and he ever since he has been using my maiden surname as he didnt like his surname. I know it is legal for a woman to adopt her husband's surname, however is it legal for a husband to adopt his wife's maiden surname.

    My husband has not offiicially changed his surname but would it be legal for him to do so?

    Could anyone kindly advise as it will be greatly appreciated.

    Welcome to the forum Addi.

    I've got zero legal knowledge on this but given everyone's constitutional right to be treated equally I'd guess he probably could adopt your surname if you're married however the bigger and possibly more important question maybe whether it will be worth headaches and inevitable confusion and chaos it will cause because I'm sure the Dept or Home Affairs won't have a system to accomodate requests like this.

      Not sure if this will help. Found it on a google search for "change in surname".

      In accordance with the provisions of the South African Births and Deaths Registration Act, 1992, a South African citizen may apply to amend his/her personal information in the Population Register by virtue of a formal application for personal amendment.
